Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Stillnest application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Stillnest is a meditation and mindfulness application that provides guided sessions, breathing exercises, ambient sounds, a meditation timer, and progress tracking. Some features require a paid subscription.

3. Eligibility

You must be at least 13 years old (or 16 in the EU/EEA) to use the App. By using the App, you represent that you meet this age requirement.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate and complete information when creating your account.
  • You must notify us immediately of any unauthorized use of your account.

5. Subscriptions and Payments

5.1 Free and Premium Tiers

The App offers both free content and a premium subscription ("Stillnest Premium") with additional features and content.

5.2 Billing

  • Subscriptions are billed through the Apple App Store or Google Play Store ("Platform").
  • Payment is charged to your Platform account at confirmation of purchase.
  • Subscription pricing is displayed in the App and may vary by region.

5.3 Auto-Renewal

  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
  • Your Platform account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.

5.4 Cancellation

  • You may cancel your subscription at any time through your Platform's subscription settings.
  • Cancellation takes effect at the end of the current billing period. You retain access to premium features until then.
  • We do not provide refunds for partial billing periods unless required by applicable law.

5.5 Free Trials

  • If offered, free trials automatically convert to a paid subscription at the end of the trial period unless cancelled.
  • Unused portions of free trials are forfeited upon purchasing a subscription.

5.6 Price Changes

  • We may change subscription prices at any time. Price changes take effect at the start of the next billing period following notice.
  • Your continued use after a price change constitutes acceptance of the new price.

6. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or disassemble the App.
  • Interfere with or disrupt the App's infrastructure.
  • Access the App through automated means (bots, scrapers, etc.).
  • Circumvent any access restrictions or usage limits.
  • Impersonate any person or entity.
  • Upload or transmit viruses or malicious code.

7. Intellectual Property

  • All content in the App — including but not limited to audio sessions, text, graphics, logos, icons, sounds, and software — is owned by Stillnest or its licensors and is protected by copyright, trademark, and other intellectual property laws.
  • Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the content for personal, non-commercial purposes.
  • You may not copy, distribute, modify, create derivative works from, publicly display, or commercially exploit any App content.

8. User Content

  • You retain ownership of any content you submit (e.g., profile information).
  • By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process it solely for the purpose of providing the service.

9. Account Deletion

  • You may delete your account at any time through the App settings.
  • Upon deletion, your personal data will be permanently removed from our servers within 30 days.
  • Active subscriptions must be cancelled separately through your Platform's settings; deleting your Stillnest account does not cancel Platform billing.

10. Disclaimers

  • The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
  • Health Disclaimer: Stillnest is a wellness tool, not a medical device. The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It is not a substitute for professional medical advice, diagnosis, or treatment. Consult your healthcare provider before beginning any wellness program. If you experience discomfort during any exercise, stop immediately.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Stillnest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Stillnest, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Stillnest is incorporated, without regard to its conflict of law provisions.

14. Dispute Resolution

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Termination

  • We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice.
  • Upon termination, your right to use the App ceases immediately.
  • Provisions that by their nature should survive termination shall survive (including intellectual property, disclaimers, limitations of liability, and indemnification).

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App. Your continued use after changes are posted constitutes acceptance.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and EULA, constitute the entire agreement between you and Stillnest regarding the App.
